Privacy policy

1.General provisions

1.1.This Privacy Policy sets out how personal data is processed and protected by the individual entrepreneur Vadym Fedorovych Hutsu (the “Provider”).

1.2.The Policy has been drawn up in accordance with the Constitution of Ukraine, the Law of Ukraine “On Personal Data Protection” and the Law of Ukraine “On Information”.

1.3.Use of the Website means that the User has read this Privacy Policy, understands its content, agrees to the conditions of personal data processing and consents to such processing.

1.4.If the User does not agree with the terms of this Privacy Policy, they must stop using the Website and the Platform.

1.5.This Privacy Policy applies solely to the Provider’s Website. The Provider does not control and is not responsible for third-party websites the User may reach through links published on the Website.

1.6.The Provider may amend this Privacy Policy. A new version of the Policy takes effect from the moment it is published on the Website, unless the new version expressly provides otherwise.

1.7.The User undertakes to provide accurate personal data. The Provider does not verify the accuracy of such data and is not liable for the consequences of providing inaccurate information.

1.8.The Policy applies in the version in force at the time the User uses it.

2.Definitions

2.1.The following terms are used in this Privacy Policy:

2.1.1.“Provider” - the individual entrepreneur Vadym Fedorovych Hutsu, who processes personal data and determines the purposes and means of such processing.

2.1.2.“User” - any individual who uses the Website, contacts the Provider or otherwise interacts with the Website.

2.1.3.“Personal data” - any information relating directly or indirectly to the User as an individual.

2.1.4.“Processing of personal data” - any operation or set of operations with personal data, including collection, recording, accumulation, storage, adaptation, alteration, use, transfer, anonymisation, blocking or erasure.

2.1.5.“Website” - the website that hosts information about the Provider’s services and through which interaction with the User takes place.

2.1.6.“Cookies” - small files stored on the User’s device and used to operate the Website and to collect analytics data.

2.1.7.“IP address” - the unique numeric address of the User’s device on the Internet.

3.Subject matter of the policy

3.1.This Privacy Policy sets out how the User’s personal data provided when using the Website, submitting requests or interacting with the Provider is collected, used, stored and protected.

3.2.Personal data is provided by the User voluntarily, in particular by - filling in forms on the Website; contacting the Provider; sending messages; using the functionality of the Website.

3.3.The Provider may process the following personal data of the User:

3.3.1.first name, surname, patronymic;

3.3.2.phone number;

3.3.3.email address;

3.3.4.account details;

3.3.5.other data the User provides voluntarily.

3.4.Technical data may also be collected automatically, in particular:

3.4.1.IP address;

3.4.2.cookie data;

3.4.3.information about the device, browser and operating system;

3.4.4.date and time of access;

3.4.5.information about the use of the Website and the Platform (including activity and interaction with the Content).

3.5.The User may restrict the use of cookies through their browser settings, however this may affect the functionality of the Website.

3.6.The Provider ensures that personal data is kept secure and does not disclose it, except in the cases provided for by this Policy or by the legislation of Ukraine.

4.Purposes of processing

4.1.The User’s personal data is processed for the purpose of:

4.1.1.ensuring the operation of the Website;

4.1.5.identifying the User;

5.Sharing data with third parties

5.3.Personal data is shared solely to the extent necessary to achieve the relevant purpose of processing.

5.4.The Provider takes reasonable organisational and technical measures to protect Users’ personal data during its transfer and processing.

6.Methods and retention periods

6.1.The User’s personal data is processed by any lawful means, with or without the use of automation.

6.2.Personal data is processed and retained for the period necessary to achieve the purposes set out in this Privacy Policy, unless otherwise provided by the legislation of Ukraine.

6.3.Personal data may be transferred to the authorised public authorities of Ukraine in the cases and in the manner provided for by the legislation of Ukraine.

6.4.The Provider takes the necessary organisational, technical and administrative measures to protect personal data against unlawful access, alteration, disclosure, loss or destruction.

6.5.If a personal data security breach is detected, the Provider takes measures to remedy it within its available technical and organisational capabilities.

6.6.The Provider does not guarantee absolute security of data, but takes all reasonable measures to protect it.

7.Rights and obligations of the parties

7.1.The User has the right to:

7.1.1.Receive information about the processing of their personal data.

7.1.2.Request rectification, updating or erasure of their personal data in the cases provided for by the legislation of Ukraine.

7.1.3.Withdraw consent to the processing of personal data by sending a corresponding request to the Provider.

7.1.4.Contact the Provider on matters relating to the processing of personal data.

7.2.The User is obliged to:

7.2.1.Provide accurate personal data.

7.2.2.Update their personal data in a timely manner if it changes.

7.2.3.Refrain from actions that may disrupt the operation of the Website or infringe the rights of others.

7.2.4.Comply with the terms of this Privacy Policy.

7.3.The Provider is obliged to:

7.3.1.Process personal data solely for the purpose set out in this Privacy Policy.

7.3.2.Take the necessary organisational and technical measures to protect personal data.

7.3.3.Not disclose personal data without lawful grounds, except in the cases provided for by this Policy or by the legislation of Ukraine.

7.3.4.Enable the User to exercise their rights in respect of personal data in accordance with the legislation of Ukraine.

8.Liability of the parties

8.1.The Provider is liable for breaches of personal data processing requirements in accordance with the legislation of Ukraine.

8.2.The Provider is not liable for harm caused to the User where such harm arose as a result of:

8.2.1.the User providing inaccurate data;

8.2.2.the User breaching the terms of this Policy;

8.2.3.unlawful actions of third parties;

8.2.4.technical failures beyond the Provider’s control.

8.3.The Provider is not liable for the disclosure of personal data if:

8.3.1.such data became publicly available through no fault of the Provider;

8.3.2.the data was obtained from third parties on lawful grounds;

8.3.3.the disclosure was made with the User’s consent or in accordance with the requirements of the law.

8.3.4.The Provider is not liable for the operation of third parties, in particular hosting, analytics, CRM, payment and other services, where the breach did not arise through the fault of the Provider.

9.Dispute resolution

9.1.The Parties shall seek to resolve all disputes and disagreements arising in connection with this Privacy Policy through negotiations.

9.2.The User has the right to send the Provider a request or complaint regarding the processing of personal data using the contact details given in this Policy.

9.3.If no agreement is reached, the dispute shall be resolved in accordance with the legislation of Ukraine.

9.4.This Privacy Policy is governed by the legislation of Ukraine.

10.Additional terms

10.1.The Provider may amend this Privacy Policy.

10.2.A new version of the Policy takes effect from the moment it is published on the Website, unless otherwise stated separately.

10.3.The User is advised to review the current version of the Policy regularly.
